These Terms of Service (the “Terms”) form a binding agreement between you and Youguide International BV (“Cybellium”, “we”, “us” or “our”), whose registered office is at MC Square, Leonardo Da Vincilaan 19, 1831 Diegem, Belgium (VAT BE1009005084). They govern your access to and use of the Cybellium platform, websites and related services (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to provide accurate account information and to keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place under your account. Notify us promptly through our contact form if you suspect any unauthorised use.
When using the Service you agree not to:
We offer free and paid plans. Where a free trial is available, we may require you to register first, and we may change or withdraw a trial at any time. The features included in each plan are described on our pricing page.
Fees for paid plans are as agreed with you at the point of purchase or in a separate written order. Unless stated otherwise, fees are exclusive of applicable taxes. If any billing terms conflict with a signed agreement between us, that signed agreement prevails.
The Service and all content we provide — including software, text, books, courses, assessments, and the Cybellium name and logo — are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use them for your own internal purposes for as long as your plan is active. We reserve all rights not expressly granted.
You keep ownership of the content and materials you submit to the Service. You grant us a limited licence to host, store and process that content solely so we can operate and provide the Service to you, as described in our Privacy Policy. You are responsible for ensuring you have the rights to submit the content and that it does not breach these Terms.
Parts of the Service use artificial intelligence to generate responses. AI output can be incomplete or inaccurate and is provided for information only. It is not professional, legal, security or compliance advice, and you should independently verify anything you rely on. You remain responsible for decisions you make based on AI output.
The Service relies on and may link to third-party services. We are not responsible for the content, policies or practices of any third party, and your use of their services is governed by their own terms.
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or completely secure.
To the fullest extent permitted by law, Cybellium will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold Cybellium harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we reasonably need to protect the Service or other users. On termination, the rights granted to you under these Terms end, while any provisions that by their nature should survive — such as intellectual property, disclaimers, limitation of liability and governing law — will continue to apply.
We may update the Service and these Terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of Belgium, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Belgium, unless mandatory law grants you the right to bring proceedings elsewhere.
Questions about these Terms can be sent through our contact form or by post to Youguide International BV, MC Square, Leonardo Da Vincilaan 19, 1831 Diegem, Belgium.
